AUTHORIZATION FORM FOR PRIVATE UTILITY LOCATING SERVICES
This Agreement is made between the undersigned client (hereinafter referred to as "Client") and County Road Utility Locating LLC (hereinafter referred to as "Company"). By signing this document, the Client authorizes the Company to perform private utility locating services as detailed herein, subject to the terms and conditions set forth below.
1. Services Provided
The Company will perform a private utility locate of objects as identified by the Client. The objects will be marked with permanent spray paint unless otherwise specified by the Client. The private locating service aims to determine the path of known utilities; however, it is important to note that this service is not intended to clear areas of utilities nor to limit or remove liability from excavation activities.
2. Fees and Payment Terms
The Company charges fees based on the nature of the service, as detailed on our Pricing Page. These rates may vary based on the job location. Payment is due day of service completion. Payment methods accepted include but are not limited to Cash, Check, Credit/Debit Card. Disclaimer: if paying by check and it does not clear, there will be a $50 service charge plus the total costs of services provided. If non-payment continues through listed payment methods the Company reserves the right to engage legal assistance for collection. In such cases, the Client shall be responsible for all attorney fees and collection costs incurred.
3. Client Responsibilities
The Client acknowledges and agrees to the following:
The Client has used or will utilize the "Call Before You Dig" service (811) to identify all publicly owned utilities before any excavation begins. The markings and locations provided by the Company are supplementary tools and should not be relied upon as the sole guide for excavation work. The Client agrees to exercise due diligence in all excavation activities, as if the Company’s services had not been obtained.
4. Limitations of Services
Radiowave Detection (RD): RD can locate nearly all metal pipes, wires, cables, or plastic pipes with tracer wires. Limitations exist for objects that do not conduct electricity, such as plastic, concrete, or terracotta pipes. Additionally, interference from nearby metal masses may affect accuracy.
Acoustic Locating (AL): AL detects sound from underground water pipes based on soil conditions. Variations in natural and artificial soil conditions may limit accuracy.
5. Indemnification
The Client agrees to indemnify, defend, and hold harmless the Company from any liabilities, damages, losses, claims, or judgments related to the Company's failure to locate underground services. This includes any consequences resulting from the Client's non-compliance with the plans and instructions provided by the Company.
6. Limitation of Liability
Under no circumstances shall the Company be liable for special, incidental, consequential, or indirect damages, even if the possibility of such damages has been communicated.
7. Warranties
The Company disclaims any warranties of merchantability or fitness for a particular purpose concerning the services or materials provided.
8. Acknowledgment
This Agreement reflects the mutually agreed-upon terms between the parties, free from any undue influence or coercion.
